This Privacy Policy covers the Nyan Gear mobile app. Personal information you submit when purchasing on nyangear.com is covered by our store Privacy Policy.

1. Who we are

This Privacy Policy explains how Nyan Gear LLC, a Colorado limited liability company ("Nyan Gear," "we," "us"), collects, uses, and shares information in the Nyan Gear mobile app (the "App"). By using the App you agree to this Policy and to our App Terms & Conditions. The App is offered from the United States and intended for U.S. users 13 and older (see Section 8).

2. Information we collect

You provide:

• Account information — your name, email address, and (if you provide it for orders/warranty) phone number. You create a password; we store it only in hashed form through our authentication provider.
• Content you create or upload — images, GIFs, drawings, text, animations, playlists, and the designs you send to your Device or post to the community feed; the name you give a Device; titles and tags on posts; and votes, reports, and blocks you make.
• AI prompts — the text prompts you enter to generate AI art.
• Support information — messages, bug/problem reports, and warranty details you submit.

Collected through App features (with your permission):

• Bluetooth — to find and connect to your Device; we store the Device's identifier and the name you give it.
• Location — your GPS location is used for Drive Mode to estimate speed and to scan for Bluetooth devices. If you enable background Drive Mode, we use "Always" (background) location so the panel can keep showing speed while your phone is locked. We do not build location history or track your movements.
• Motion — on iOS, motion-sensor data is used to smooth the speed estimate and detect hard braking, processed on your device.
• Camera and photos — only when you choose to capture or select an image to show on your Device or post.
• Music "now playing" data — when you use Live Music, we read the title/artist of your currently-playing song (from Apple Music, your phone's media session, or your linked Last.fm/Spotify account) to display it on the panel.
• Push token — a device token so we can send you notifications.
• Purchase data — records of your Nyan+ subscription and AI-credit purchases (processed by the app stores and RevenueCat; we do not receive your full card number).
• Basic diagnostics — limited crash and error information to keep the App working.

We do not use third-party advertising or tracking SDKs, and we do not track you across other companies' apps or websites.

3. How we use information

We use information to: operate and provide the App and your Device features; create and secure your account; process purchases and manage subscriptions and credits; run and moderate the community feed (review, approve, remove content, and act on reports and blocks); send you service and (if you opt in) other notifications; provide support and handle warranty questions; keep the App safe and prevent abuse; and comply with law. We do not sell your personal information.

4. How information is shared

We share information only as needed to run the App:

• Service providers / processors: Supabase (backend, authentication, database, storage); our AI provider (fal.ai), which receives your AI prompts (and any image you choose to transform) to generate art — do not include personal or sensitive information in prompts; RevenueCat and the Apple App Store / Google Play (process and validate purchases; receive your app-user identifier and purchase records); Google Firebase (Cloud Messaging) (delivers push notifications using your device token); and Shopify (used to verify an order number for warranty or account features).
• Music services you connect — Apple Music, Last.fm, and Spotify. If you use Live Music, we send the information those services require (for example, your Last.fm username or a Spotify authorization) to fetch your now-playing track. Their own privacy policies govern their use.
• Other users (public information) — your username, any name shown on your community-feed posts, and any Device or panel name you choose to share are visible to other riders. Content you post to the feed is public after approval.
• Legal and safety — we may disclose information to comply with law, enforce our Terms, or protect the rights, safety, and property of Nyan Gear, our users, or the public.
• Business transfers — information may transfer as part of a merger, acquisition, or sale of assets.

5. Location, in detail

Drive Mode uses your phone's location to estimate speed. With your permission we may use background ("Always") location so the display keeps working while the phone is locked. You can change or withdraw location permission at any time in your phone's Settings; if you decline background access, Drive Mode still works while the App is open. Location is used only for the App's speed/scan features and is not sold or used for advertising. Drive Mode is a novelty display and not a safety, navigation, or emergency service.

6. AI features

AI art is generated by a third-party AI provider (fal.ai). Your prompts (and any source image you submit) are sent to that provider to create the output. We may store and review generated content, including because it can be posted to the community feed. Please do not submit prompts or images containing personal, confidential, or sensitive information.

7. Data retention and deletion

We keep information for as long as your account is active or as needed to provide the App, then delete or de-identify it, except where we must keep it for legal, security, backup, or dispute-resolution reasons. You can delete your account in the App (Settings → Account), which deletes your account and associated personal data, including your posts (public and pending), device names, push token, and credit records. Content other users have already saved, and limited records we must retain by law, may persist. If your account has an active Nyan+ subscription, deleting the account does not cancel App Store / Google Play billing — manage that in your store subscription settings. You can also email app@nyangear.com for help with a data or deletion request.

8. Children

The App is not directed to children under 13, and we do not knowingly collect personal information from anyone under 13. If you are under 18, you may use the App only with your parent's or guardian's permission. If you believe a child under 13 has provided us information, email app@nyangear.com and we will delete it.

9. Your choices and rights

• Permissions — you control Bluetooth, location, motion, camera, photos, and notifications in your phone's Settings (some features won't work without them).
• Notifications — you can turn off push notifications in Settings.
• Access / deletion — you can delete your account in-app or contact us to access or delete your information.
• State privacy rights — depending on where you live (for example, California, Colorado, and other states), you may have rights to access, correct, delete, or obtain a copy of your personal information, and to opt out of "sale" or "sharing." We do not sell your personal information or share it for cross-context behavioral advertising. To exercise a right, email app@nyangear.com; we will not discriminate against you for doing so.

10. Security

We use reasonable administrative and technical safeguards (including encryption in transit and access controls through our providers) to protect information. No system is perfectly secure, and we cannot guarantee absolute security. Keep your password confidential and notify us of any unauthorized use.

11. International users

The App is operated from the United States and intended for U.S. users. If you access it from elsewhere, you understand your information will be processed in the United States under U.S. law.

12. Changes to this Policy

We may update this Policy from time to time. If we make material changes, we will provide reasonable notice (in the App or by email) and update the "Last updated" date. Your continued use after changes take effect means you accept the updated Policy.
